Terms of Service
This is a draft. It stays a draft until the name of whoever signs, [legal name of whoever signs], is filled in and a lawyer has read it. Anything highlighted like this is still to be decided. Questions about this draft: help@barrierline.com.
1. Who this is between
These terms are between [legal name of whoever signs] (“we”) and the pest control company that signs up (“you”). They cover Barrierline: the phone app for your technicians, the office dashboard, and the servers behind them (together, “the service”).
2. Your account
- We set up your company with you. Your owner login can add office logins and connect phones.
- You decide who gets a login or an invite, and you’re responsible for what’s done with them.
- If a phone is lost or a tech leaves, remove their login in Team. It stops working right away.
3. Your data is yours
- You own everything you or your techs put in: customers, service records, products, photos, signatures, notes.
- We use it only to run the service for you and to support you. We don’t sell it, we don’t show ads, and we don’t use it to market to your customers.
- You can download your records at any time from the office website: Settings, Download everything. They come as spreadsheets; photos and videos open from each visit’s record. No fee and no request to us.
4. Records and the law
- The record check helps your techs fill in what your state requires on a service record. It isn’t legal advice.
- You remain responsible for following pesticide laws and label directions, and for keeping records as long as your state requires. In Arizona that’s 3 years.
- Termite reports (TARF) are tracked in the app, but filing them with the state is up to you.
5. Reserved
This section is kept so the numbers of the sections after it stay the same. Nothing in it applies to you.
6. Price and paying
- The price is per technician: [price per technician: not decided yet]. Everything is included; nothing is locked behind a higher plan.
- [The first companies start free; see their pilot agreement.]
- We’ll give you at least 60 days’ notice before any price change. [A founding price stays the same for the first three years.]
- [setup fee: not decided yet.] Prices don’t include sales tax where it applies.
- We don’t take your customers’ payments, so we never hold your money or your customers’ cards.
7. Money-back and cancelling
- 60-day money-back: if the service isn’t working for you in the first 60 days of your first paid year, tell us and we’ll refund that year.
-
Cancelling is not renewing. An email to help@barrierline.com is enough.
- Yearly: the service runs to the end of the year you paid for, then stops. [No refund for the rest of that year after the first 60 days.]
- Monthly: it stops at the end of that month.
- No exit fee, ever, and no bill after you cancel.
- We’ll remind you 30 days before a yearly renewal.
8. When the service ends
- You have [90] days after the end to download your records. We’ll tell you how. Arizona makes a pest control company keep its service records for 3 years, so download them first.
- After the [90] days we delete your company’s data from the service, within [7] days, and from our backups within [35] more days. [Or, if you ask, we keep a read-only copy for your state’s record-keeping period at no charge.]
- We can end the service for a company that doesn’t pay or breaks section 10, with [30] days’ notice when we can give it. You’d still get the [90] days to download your records.
9. Keeping it running, and support
- The phone app saves each stop on the phone first and sends it when there’s signal.
- We’ll do our best to keep the service running, and we’ll tell you about planned maintenance ahead of time.
- Support: write to help@barrierline.com. There’s no support phone line or fixed hours yet; when there are, they’ll be written here.
10. Fair use
Don’t use the service to break the law, to get into another company’s data, to attack or overload it, or to resell it.
11. Limits
- Apart from the promises written here, the service is provided as it is, without other guarantees.
- [Our total responsibility for any claim is limited to what you paid us in the 12 months before it, or $100 if that’s more.] We’re not responsible for lost profits or indirect losses.
- [Lawyer: review this section against the promises above.]
12. Changes to these terms
We’ll give you at least 30 days’ notice before a change takes effect. A change can’t take away your data, your right to download it, or the promises in sections 3 and 7.
13. Law and contact
- Arizona law applies. [Disputes go to the courts in Maricopa County, Arizona.]
- Questions: help@barrierline.com, [legal name of whoever signs], [address].
